End User Agreement

This agreement sets out the terms on which you may use the FaceEcho mobile application. Please read it before you use the app.

Who is this agreement with?

FaceEcho is published by Vi Signal Inc., 5925 Almeda Rd, 12809, Houston, TX 77004, United States. In this agreement, “we”, “us” and “our” mean Vi Signal Inc., and “you” means the person using the app.

You may have downloaded FaceEcho from Apple’s App Store or Google Play. This agreement is between you and us alone. Apple and Google are not parties to it and are not responsible for the app or its content, although each has rights described in the section on Apple and Google below.

What are you agreeing to?

By downloading, installing, creating an account or otherwise using FaceEcho, you accept this agreement. If you do not accept it, please do not use the app.

You also confirm that you are legally able to enter into a contract, and that you are not barred from using the app under the laws that apply to you.

Who can use FaceEcho?

FaceEcho is intended for adults. Where a young person may use it, the consent rules below apply, and they mirror our Privacy Policy.

Where you are A child is What we require
India Under 18 Verifiable consent from a parent or lawful guardian before any use
United States Under 13 Verifiable parental consent; the app is not directed at children under 13
EEA and UK Under 16, or the lower age your country sets Consent from a person with parental responsibility

You are responsible for the accuracy of the information in your account and for keeping your login details secure. Please tell us promptly if you believe someone else has accessed your account.

What licence do we give you?

We grant you a personal, limited, revocable, non-exclusive, non-transferable and non-sublicensable licence to install and use FaceEcho on devices you own or control, for your own non-commercial use, in accordance with this agreement and with the usage rules of the app store you downloaded it from.

Where Apple’s Family Sharing or volume purchasing applies, the app may be used by other members of your family group in line with Apple’s rules.

This licence also covers any updates we provide, unless an update comes with its own separate licence.

What may you not do with the app?

Some limits exist to protect other people, and some exist to protect the app itself. Please do not:

  • Sell, rent, lease, sublicense or otherwise make FaceEcho available to anyone else.
  • Reverse engineer, decompile or disassemble the app, or attempt to derive its source code, except where the law expressly permits this despite this restriction.
  • Copy or modify the app, or create works derived from it, beyond what this agreement allows.
  • Remove or obscure any copyright, trademark or other ownership notice.
  • Access the app by automated means, scrape it, or place unreasonable load on our systems.
  • Interfere with or circumvent any security or access control.
  • Upload a photograph of anyone other than yourself, unless that person has given you their informed consent to scan their face using FaceEcho. This one matters: face data is protected by specific laws in several places, and uploading someone else’s face without their consent may break them.
  • Use FaceEcho, or anything it produces, to make decisions about another person, including decisions about employment, insurance, credit, housing or access to services.
  • Use the app for any unlawful purpose, or in any way that infringes someone else’s rights.

FaceEcho is not built to meet the requirements of sector-specific regimes such as HIPAA, FISMA or the Gramm-Leach-Bliley Act. If your use of the app would fall under a regime like these, please do not use it.

Is FaceEcho a medical device or medical advice?

No. FaceEcho is a wellness and information tool. It is not a medical device, it does not diagnose, treat, cure or prevent any condition, and nothing it produces is medical advice.

FaceEcho has not been reviewed, cleared or approved by the United States Food and Drug Administration, by India’s Central Drugs Standard Control Organisation, or by any comparable regulator.

The app looks at visible features in a photograph and describes patterns it observes. Those observations can be wrong, incomplete, or affected by lighting, image quality, skin tone, camera hardware and many other things. A result that looks reassuring does not mean you are well, and a result that looks concerning does not mean you are unwell.

Please use FaceEcho as a prompt to pay attention, not as an answer. Always speak to a qualified healthcare professional about your health, and never delay seeking care, disregard professional advice, or stop a treatment because of something FaceEcho showed you.

If you think you may be having a medical emergency, contact your local emergency services or go to your nearest emergency department immediately.

What are expert sessions, and what are they not?

FaceEcho may offer sessions with members of our team. These sessions are informational and educational. They are intended to help you understand your results, think about your routine, and prepare for a conversation with a healthcare professional.

An expert session is not a clinical consultation. It does not create a doctor–patient, practitioner–patient or any other professional care relationship. No diagnosis is made, no treatment is prescribed, and nothing said in a session should be treated as medical advice. Everything in the section above applies equally to expert sessions.

Sessions may not be available in every country, in every language, or at all times, and we may change or withdraw the feature.

Who owns what?

We own FaceEcho — the software, the models, the designs, the text, the name and the logo — together with all intellectual property rights in it. This agreement gives you permission to use the app. It does not transfer ownership of anything to you.

You keep ownership of your photographs and your scan results. You give us permission to process them so that we can provide the app to you: to run the scan, produce your report, store your history and support the features you use. That permission is limited to running the service, lasts only as long as we need it for that purpose, and is described in full in our Privacy Policy. We do not use your face data for advertising, and we do not use it to train artificial intelligence models.

If you send us an idea, a suggestion or feedback, you allow us to use it without owing you anything for it. We would rather receive your ideas than have to decline them for legal reasons.

How do subscriptions and payments work?

Parts of FaceEcho are free to use. Others are available through a paid subscription. Where a feature requires a subscription, we will say so before you buy.

Subscriptions bought inside the app are processed by Apple or Google, depending on where you downloaded it. That means your payment details, your billing record and your purchase history sit with them, not with us.

Renewal and cancellation

Subscriptions renew automatically at the end of each billing period so that your access continues without interruption. You can turn off automatic renewal at any time in your Apple or Google account settings — it takes a moment and does not require you to contact us. To avoid being charged for the next period, please turn it off at least 24 hours before the current period ends, which is the window Apple and Google apply.

If you cancel, you keep access until the end of the period you have already paid for. Nothing is cut off early.

Free trials

Where we offer a free trial, it converts into a paid subscription at the end of the trial unless you turn off automatic renewal before it ends. We will make the trial length clear when you start it.

Refunds

Because Apple and Google handle the payment, they also handle refunds under their own policies, and a refund request goes to them rather than to us. If you run into difficulty, write to us anyway — we will help you where we are able to, and we will tell you honestly when a decision is not ours to make. Nothing here affects any refund or cancellation right you have under the consumer law of your own country.

Changes to prices and plans

If we change the price of a subscription or materially change what a plan includes, we will tell you in advance, and the change will only apply from your next billing period. You will always have the chance to cancel before a new price takes effect.

What do you need in order to run FaceEcho?

FaceEcho requires a compatible device, currently iOS 15 or later or Android 9 or later, a working camera, and an internet connection. Any mobile data or network charges are yours to pay.

We try to keep the app working on current devices and operating system versions, but we cannot guarantee that it will work on every device, or that it will continue to support older hardware and software indefinitely. Keeping your device and the app reasonably up to date is your responsibility.

How is your personal and face data handled?

Everything about what we collect, why we collect it, who we share it with, how long we keep it and what rights you have is set out in our Privacy Policy, which forms part of your agreement with us. We have deliberately not repeated it here, so that there is only ever one version to read and one version to keep current.

Can we change the app or this agreement?

We may add features, change how features work, or retire features. Where a change materially reduces what the app does for you, we will give you reasonable notice unless we have to act immediately for legal or security reasons.

We may also update this agreement. If a change is material, we will tell you before it takes effect, in the app, by email, or both, and we will give you at least 30 days’ notice where we reasonably can. If you continue using FaceEcho after a change takes effect, you accept the updated agreement. If you would rather not, you can stop using the app and close your account.

Can your access be suspended or ended?

You can stop using FaceEcho at any time, and you can close your account from within the app or through the account closure page.

We may suspend or end your access if you break this agreement in a way that is serious or repeated, if we are required to by law, or if we reasonably believe your use is putting other users, another person, or our service at risk. Except where it would be unlawful or unsafe to do so, we will tell you why and give you a chance to put things right.

When your access ends, your licence to use the app ends with it. What happens to your data afterwards, including how long anything is retained and when it is deleted, is governed by our Privacy Policy. The sections of this agreement that are meant to survive — ownership, disclaimers, limits on liability, indemnity and governing law — continue to apply.

What do we promise about the service?

We provide FaceEcho with reasonable skill and care, and we work to keep it accurate, available and secure.

Beyond that, and to the fullest extent the law allows, the app is provided “as is” and “as available”. We do not warrant that it will be uninterrupted or error-free, that defects will be corrected, that it will meet your particular expectations, or that its observations will be accurate or complete in your case.

If you are a consumer, you have rights under the law of your country that cannot be signed away, in India, in the EEA and UK, and in many US states. Nothing in this agreement limits or removes those rights. Where your local law gives you a guarantee we cannot exclude, that guarantee applies regardless of what this section says.

What are we responsible for if something goes wrong?

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of data, loss of goodwill, or loss arising from a decision you made on the basis of something the app showed you.

Where we are liable, our total liability to you for all claims arising out of or connected with FaceEcho is limited to the greater of the amount you paid us in the twelve months before the claim arose, or one hundred United States dollars.

Nothing in this agreement excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for a breach of your statutory consumer rights, or for anything else that the law does not allow us to exclude or limit.

What happens if you break this agreement?

If a third party brings a claim against us because you used FaceEcho unlawfully, broke this agreement, or uploaded someone’s photograph without their consent, you agree to cover the reasonable losses and legal costs we incur as a result. This applies only to claims caused by your own acts or omissions, not to anything caused by us.

Which country’s law applies, and how are disputes resolved?

This agreement is governed by the laws of the State of Texas, United States, without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Let us try to sort it out first

If you have a problem, please write to us at info@faceecho.ai and describe it. Most things can be resolved this way. We ask that you give us 30 days to respond and work with you before starting formal proceedings, and we will do the same before we start any against you.

If that does not work

Any dispute that remains unresolved may be brought before the state or federal courts located in Harris County, Texas, and we each agree to the jurisdiction of those courts.

If you are a consumer, this does not take away your local rights. If the law of the country where you live gives you the right to bring proceedings in your own courts, or to have your own country’s consumer law applied, you keep that right. This paragraph is here because consumer protection law in India, the EEA and the UK overrides a clause like the one above, and we would rather say so plainly than let you find out the hard way.

What do Apple and Google require us to say?

These terms are required by the app stores, and they apply if you downloaded FaceEcho from one of them.

  • This agreement is between you and Vi Signal Inc. only, not with Apple or Google.
  • We, not Apple or Google, are solely responsible for FaceEcho and its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to conform to any warranty that applies, you may tell Apple, and Apple may refund the purchase price. To the fullest extent permitted by law, Apple has no other warranty obligation in respect of the app.
  • We, not Apple or Google, are responsible for addressing any claim that the app or your use of it fails to conform to a legal requirement, or gives rise to a product liability or consumer protection claim.
  • We, not Apple or Google, are responsible for investigating and resolving any claim that the app infringes someone else’s intellectual property.
  • You confirm that you are not located in a country subject to a United States Government embargo or designated as a terrorist-supporting country, and that you are not on any United States Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.
  • You must also comply with the Apple Media Services Terms and Conditions or the Google Play Terms of Service, as applicable. Nothing in this agreement is intended to conflict with them.

Anything else?

This agreement, together with our Privacy Policy, is the whole agreement between us about FaceEcho, and replaces anything said before it.

If any part of it is found to be unenforceable, the rest continues to apply. If we do not enforce a right straight away, we have not given it up. You may not transfer your rights under this agreement to anyone else; we may transfer ours to a company that takes over our business, and we will tell you if that happens. We may send you notices in the app or by email to the address on your account. Headings are there to help you navigate and do not affect how the agreement is read. This agreement is written in English; if it is translated and the versions differ, the English version applies.
